These Terms govern use of the CommunityHub application and related services (the "Service"). Our customer is the community organization that signs up — an HOA, condo or neighborhood association, or property management company (the "Association"). Individual residents are end users, covered by separate Resident Terms accepted at signup. If you accept these Terms for an Association, you represent you're authorized to bind it.
The Service is a communication, amenity-booking, and request-tracking tool with an optional private resident feed. Critically:
You're responsible for activity under your accounts and for keeping credentials secure. Don't misuse the Service, upload unlawful content, infringe others' rights, or attempt to breach security. We may remove content, suspend or disable users, or disable the resident feed at our discretion to keep the Service safe and lawful. The Association may switch the resident feed off at any time.
Residents own what they post and grant Gatherside a limited license to host, store, and display it solely to operate the Service. We're not obligated to monitor content but may review and remove it. We follow a DMCA notice-and-takedown process; to submit a notice, contact jackfowles@gatherside.com. Housing-related content that violates Fair Housing law will be removed.
The Association's data belongs to the Association. On termination, data is available for export for 30 days, after which we may delete it within 60 days. Either party may terminate as described in the order or with 30 days' written notice.
Setup fee and monthly subscription are stated in your order. Monthly fees are billed in advance and are non-refundable except as required by law. Fees may change at renewal with prior notice.
The Service does not currently include advertising, and no revenue-share arrangement is offered. If advertising is introduced in the future, it will be optional for the Association, ads will be clearly labeled "Sponsored," and advertisers will be independent third parties we don't endorse. Any revenue-share terms would be stated in a written order agreed at that time. In no case would advertisers receive resident identities — aggregate impression and click counts only.
The Service is provided "as is." We use commercially reasonable efforts for availability but don't promise a specific uptime SLA. To the maximum extent allowed by law, we disclaim implied warranties, and our total liability is capped at fees paid in the 12 months before the claim. We're not liable for indirect or consequential damages.
The Association indemnifies Gatherside against claims arising from resident-posted content and the Association's use of the Service. We indemnify the Association against claims that the Service itself infringes third-party intellectual property.
South Carolina law governs, and disputes will be resolved in the state or federal courts located in South Carolina.
We may update these Terms with notice; continued use after the effective date means acceptance.

We collect the minimum needed to run the Service.
To operate and secure the Service, authenticate users, send notifications, provide support, and improve reliability.
Only service providers that help us run the Service — hosting/platform providers (Base44, Wix), email/messaging providers, and analytics — under confidentiality obligations. We do not sell personal data.
The Service does not currently serve advertising, so no advertising data is collected or shared. If advertising is introduced in the future, advertisers would receive aggregate impression and click counts only — never resident identities or personal information — and this policy would be updated before any such change takes effect.
Request access, correction, or deletion at jackfowles@gatherside.com. Where state laws (e.g., California CCPA/CPRA) grant additional rights, we honor them as required.
The Service is not intended for children under 13 and we do not knowingly create under-13 accounts.
We keep personal data as long as needed to provide the Service and as required by law, then delete or de-identify it. We use reasonable safeguards; if a breach affects your data we'll notify affected parties as required by law.
